The Joker IS the main villain in TDK — have you not seen the trailers? Heath Ledger completed all of the work on the film before he passed away.

And this article clarifies that this is just a rumor – hence the question mark in the title. Tool.

Who’s responcible for such a bullshit rumour? Listen, if you’re going to try and fool fans into believing flase info about a Batman flick, then A) use a villain that’s at least somewhat believable, both in terms of how they’ll interact in Nolan’s Batman universe & one that’s at least wanted by people on both sides. And B) wait until we’re close enough to the production of the 3rd to actually have a chance of convincing people this or that character is in the film. Chances are the basic storyline hasn’t even been written yet. The film will most likely come out in 2011. It’s just way too early to start fucking with people.

Besides, based on what we know about TDK so far, it’s pretty obvious who the villains will be; Two-Face for sure as the film’s big baddie, maybe Joker if they recast. I imagine Scarecrow will be back as well. And 2 other villains, who I will not name at this moment to keep from ruining the surprise in TDK, for those that haven’t heard the news already.
